Welcome to GetSport.fi, a service owned and operated by NextWeb Oy, registered at Äijänkatu 8C 19, Kotka, Finland, Y-tunnus: 3337685-6, VAT: FI33376856. GetSport.fi is an online platform that allows users to book sports facilities, find trainers, and other sports specialists. By using the GetSport.fi platform, you agree to these Terms of Use and Refund Policy.

Terms

In order to ensure clarity and understanding, this section defines and explains key terms used in these Terms of Use that may be ambiguous or open to interpretation.

  1. "GetSport.fi" or "Service": Refers to the online platform provided by NextWeb Oy, where users can book sports venues and choose sports specialists whose profiles are publicly listed.
  2. "NextWeb Oy": The company that owns and operates GetSport.fi.
  3. "User": Any individual or company who has registered an account on GetSport.fi or GetSport.io, including sports specialists, sports venue providers, and athletes.
  4. "Sports Specialist": A professional in the sports field, such as a trainer, coach, or therapist, who has a publicly listed profile on GetSport.fi (both individual or company).
  5. "Sports Venue": A physical location or facility where sports activities can be conducted, such as a gym, stadium, sports hall etc.
  6. "UGC (User-Generated Content)": Any content created and uploaded by users, such as texts, images, videos, or any other form of media, that is available on GetSport.fi.
  7. "Referral Program": A promotional program offered by GetSport.fi where users can invite others to join the service, potentially receiving benefits such as reduced service commission or free usage for a limited time.
  8. "Administrative Panel": A section of the GetSport.fi platform where users can manage their account settings, profile information, and other service-related features.
  9. "Code of Conduct": A set of rules outlining the expected behavior of users on GetSport.fi, including restrictions on offensive language and disrespectful behavior.
  10. "Commission": A fee charged by GetSport.fi for using the platform and its services, typically a percentage of the transaction amount between the user and a sports specialist or sports venue provider.
  11. "Cancellation": The act of terminating a booking, appointment, or reservation made through GetSport.fi, either by the user, sports specialist, sports venue provider, or NextWeb Oy. Cancellations may be subject to specific terms, conditions, and fees as outlined in these Terms of Use and the respective cancellation policies.
  12. "Refund": The reimbursement of funds to a user as a result of a cancellation or other circumstances as outlined in these Terms of Use and the respective refund policies. The refund amount and process may vary depending on the situation and the policies of the sports specialist, sports venue provider, or NextWeb Oy.

By using and accepting these Terms of Use, users acknowledge and agree to the definitions and explanations of these terms as outlined above.

User Categories

1. Sports Facility Owners

Owners of sports facilities can list their facility on our website for rent. They can accept online payments (through our service) or offline payments (booking through GetSport.fi, but payment is made directly to the facility). For online payments, we process the payment and transfer the funds to the facility's bank account within 7 days (in some cases, due to technical issues, the payment may take 7-31 days). For offline payments, the facility receives payment directly from the client, but booking is done through GetSport.fi, and we invoice the facility for our commission. In both cases, our service commission is 10%. Facility owners are responsible for paying taxes and other possible government fees. NextWeb Oy pays a 24% tax in Finland on provided services – the tax is already included in the 10% service commission. Facility owners can also install a booking widget on their website to accept direct bookings. In this case, online payment incurs a 5% commission, while offline payment is free. Facility owners must fulfill bookings made through GetSport.fi and cannot unilaterally cancel a client's booking. If the facility is unable to accommodate the client, the owner must refund the client's payment in full and provide an alternative sports facility (same time and date, within a 1-15 km radius, and if the price is higher, compensate the client for the price difference between the two bookings). Clients can cancel bookings up to 1 hour before the session without compensation to the facility owner, unless the facility's specific rules state otherwise on their GetSport.fi page.

2. Trainers and Other Sports Specialists

Trainers and other sports specialists gain access to the platform's features for a fixed monthly fee, ranging from €3 to €150, depending on the account's features. Specialists receive at least 14 days of free service usage to determine if the service meets their needs. By paying the subscription fee, specialists confirm that the service is satisfactory and have no claims against NextWeb Oy regarding the service's capabilities.

3. Athletes

Athletes can book sports facilities and choose any sports specialist with a public profile on GetSport.fi. NextWeb Oy is not responsible for the quality of services provided by facilities or specialists and does not guarantee that they hold the necessary licenses to provide certain types of services. Athletes are responsible for obtaining insurance and consulting with a doctor or other specialist before starting any training or procedures with specialists listed on GetSport.fi.

General Terms

Age requirement: The service is available only to users aged 18 and above. By continuing to use the service, users confirm they meet this age requirement. Account termination: NextWeb Oy reserves the right to delete or suspend any user profile for reasons including, but not limited to, violation of these terms, applicable laws, abuse of the service's features, provision of low-quality services, fraud, etc. Data security: NextWeb Oy exercises reasonable protection for user accounts and confidential information. NextWeb Oy is not responsible for any user account or associated actions if a malicious party gains access due to careless or negligent storage of the user's login credentials. Reviews: Reviews on GetSport.fi are left by real users and reflect their personal opinions. NextWeb Oy reserves the right to publish, delete, or modify reviews at its discretion. Fake reviews may be removed, and attempting to post them may result in a lifetime ban from GetSport.fi. Intellectual Property Rights

All materials provided by the service are protected by copyright or other forms of intellectual property rights. Users may not use these materials without prior permission.

User-Generated Content

User-generated content (UGC) is created by users, and GetSport.fi administration is not responsible for its content. Users publishing prohibited, discriminatory, or derogatory content are directly responsible for such content. If NextWeb Oy deems any user content harmful to the service's reputation or in violation of these terms, the administration reserves the right to remove or modify any such content unilaterally.

Limitation of Liability

GetSport.fi is not liable for any damages arising from the use of the service, including any direct or indirect losses resulting from the use or inability to use the service. NextWeb Oy's liability to any contracting party cannot exceed the net profit amount received from the contracting party during a one-month period.

Testing Mode

GetSport.fi is currently in testing mode, and the availability of all features and services 24/7 for all user types is not guaranteed. Users will be notified of the end of the testing mode and the transition to regular operation in a future update of these terms.

Prohibited Uses

Users are strictly prohibited from using the GetSport.fi service for any purpose not intended by the service, including but not limited to fraud, misrepresentation, or any other illegal or unethical activities. NextWeb Oy reserves the right to terminate or suspend a user's account in case of any violation of this provision.

Referral Program

Participation in the GetSport.fi referral program is voluntary. No cash payouts will be made, and all bonuses are limited to a temporary reduction of the service commission or temporarily completely free usage for sports specialists. Other terms and conditions for the referral program are outlined in the users' administrative panels.

Code of Conduct

Users are strictly prohibited from using offensive language or engaging in personal attacks, insults, or any other form of disrespectful behavior in chats between users, reviews, texts, and media files on GetSport.fi. NextWeb Oy reserves the right to remove any content that violates this code of conduct or take further action, including account suspension or termination.

Updates to Terms

NextWeb Oy reserves the right to make changes to these terms from time to time and will notify users by publishing a new version of the terms on the website.

Privacy Policy

The Service adheres to a privacy policy, and users can review it to obtain information about the collection, storage, and use of their personal data.

Access Restrictions

NextWeb Oy may, at its discretion, restrict access to the Service for certain groups of users or geographical regions.

Third-Party Websites

The Service may contain links to third-party websites, and NextWeb Oy is not responsible for the content, services, or products offered on these websites.

Account Transfer Prohibition

Users may not transfer their account to other individuals without prior consent from NextWeb Oy.

Account Deletion Request

To delete your account, please follow these steps:

  2. In the subject line of the email, please write "Account Deletion Request".
  3. In the body of the email, provide the following information:
    • Your full name
    • Username or account ID
    • Reason for the account deletion request (optional)
  4. Once we receive your email, our team will review your request and initiate the account deletion process.
  5. Please note the following important points regarding account deletion:
    • Account deletion is a permanent action and cannot be reversed. All data associated with your account will be permanently deleted.
    • Any active subscriptions or paid services linked to your account will be canceled, and no refunds will be provided.
    • Once your account is deleted, you will no longer have access to any content, settings, or features associated with the account.
  6. We strive to process account deletion requests in a timely manner. However, please allow up to 45 days for the deletion process to be completed.
  7. It's important to ensure that you have securely backed up any important data or files from your account before requesting deletion, as we cannot recover any deleted information.
  8. By initiating the account deletion process, you understand and accept that any personal information or data associated with your account will be deleted in accordance with our privacy policy.
  9. If you have any outstanding or unresolved issues with your account or our services, we recommend contacting our support team prior to requesting an account deletion.
  10. Once the account deletion process is complete, you will receive a confirmation email.

Force Majeure

NextWeb Oy shall not be liable for any failure or delay in the performance of its obligations under these Terms if such failure or delay is due to force majeure events, including but not limited to natural disasters, wars, terrorist acts, civil unrest, strikes, or any other unforeseen events beyond the control of NextWeb Oy.

By using the Service, users agree to the use of electronic documents and communication methods for entering into agreements and exchanging information with NextWeb Oy and other users of the Service.

Waiver of Rights

NextWeb Oy's failure to exercise any right or provision of these Terms in relation to a user shall not constitute a waiver of such right or provision in relation to other users or in the future.
